Hi,

I'm looking for opinions on this one. I listed my Mum's old Mitsubishi on Ebay, as a 10-day listing. It 'sold' on the 29th March but the buyer failed to contact me, though I sent an invoice and follow up emails. So, I opened an unpaid item case (now finished) and will receive a valuation fee credit.

Enter 'buyer' No2. The car was relisted and 'sold' again on the 11th April. This buyer first asked for contact details. Then, it's been...

1. Best pick up time?

2. Can you bring the car North to Keswick?

3. I want to check the car (even though you've a good feedback record (100%). By the way, what fuel does the car use?

4. I'll try to get a lift to come to you asap.

5. My local mechanic says check it out on the 'net. Then two quotes saying Carismas die of carbon build up at about 60,000 miles. Will you send me a copy of the MOT emissions test result.

6. Two more quotes, concerning carbon build up, plus (in effect), you'd better send me a copy of the test results?

(Moving to personal email system...test sheet sent as attachment.)

7. The sheet has the wrong vehicle make and isn't signed (registration, mileage and date all correct.)

(Then phone conversation...'I may be down tomorrow but will consult mechanic.' He didn't show, call or email.)

8. I saw the mechanics...the readings look OK but there's no way of telling whether they apply to this car, could be a possible mistake. Mechanics suggest a new emissions test when I come to 'check the car'. (No suggestion of who pays.)

As far as I'm concerned, this is suggesting I'm a liar and am presenting a dodgy emissions cert (possibly the MOT garage's mistake). I'm a very patient soul but even my patience is wearing thin. I feel I'm being f*****d about.

I could (in no particular order)...

(a) Open an unpaid item case in EBay

(b) Close the transaction

(c) Tell this man to f**k off

(d) Relist the car (again)

Sorry this is so long and irritating but I'd like to know what you folks think. Please note that the buyer's name, location and personal details are not in this post.

Thanks, DB-H

Depending on how much it went for and how badly you need the money, I'd tell him to lick my left one and chuck it back on a site with a better reputation for selling cars!!!

It's only been 4 days. See how you get on.

So far, he's tested your patience a little. That's not enough to rescind a contract. You wouldn't want to go to court and say "Well, he annoyed me so I decided not to sell it to him despite him having contracted to sell it to him."

Give him plenty of rope to hang himself.

If he won the auction he has contractually agreed to buy the car so long as it is not significantly different to the description. If he wanted to know this lot to decide if he wants the car or not he should have asked you before buying!

Update

I've written to the buyer, having consulted EBay. I've given him choices...

  • Call the MOT garage for verification
  • Accept an unpaid item strike
  • Accept cancellation of the transaction
I've also asked for the issue to be resolved by 6pm Saturday so I can re-advertise.

Guess what...no response over nearly two hours.

BTW, thanks for the input so far, people!

Tell him you are fully confident that the vehicle matches the description and will, within reason, provide information he asks for but that you are now giving him 7 days to complete the transaction.

ARGH ebay does my nut these days.

If he was so concerned by all of these things he should have come to see the vehicle whilst it was listed and before bidding.

Had similar trouble selling my dads hyundai on ebay.

Bid on the car a few times (they were outbid a few times), came to pick up the car and then asked to test drive it, i asked to see their insurance, they said they havent got any documents but 'don't worry its fine', to which i said, no its not fine, until you sign the V5 it is my dads problem is you cannot prove you are insured so i will drive it for you (i was on the policy). They made LOTS of comments when on the test drive (oh is that a noise(thats the engine revving you idiot)? doesn't handle very well does it? hhmmm i thought it would be quicker) .

Then they started trying to haggle: 'well £720 does seem like alot, would you take 550?' 'if you dont think its worth 720 why did you bid that' 'well we hadnt seen it so thought it was worth bidding then pay a fair price when we come to see it, 600 sound better?' 'no, if you wanted to pay what you thought was a 'fair' price you should have viewed the car before bidding.' 'ok 700?' '720' 'ok 720'.

Does your auction contract state how fast he must complete the transaction, and the concequences if he doesn't pay within 5 days? Is there a reason your MOT doesn't match the vehicle? No response in 2 hours is also not that much of a shock.

Given that I'm presently assisting someone over a broken down ebay transation in a claim for excess of £3500, and also in a counterclaim for approximately the same sum, I'd suggest caution. So far, I'm not convinced you'd have the better of the matter, if it came to a court of law.

So far, he's talking, which isn't the clearest indication of timewasting. He's also making sounds that he wants to visit the car & buy it. He might be able to provide a list of reasons why he hasn't visted it yet, were it to go to court.

If you didn't specify a time when the transaction must be completed, that's you own fault. I'm also surprised your MOT information doesn't match your vehicle which is an inconsistency most buyers would find worrying.

Be polite and accommodating, but if you feel they are being completely unreasonable do point it out. You, as the seller, need to cover yourself, otherwise the buyer can do whatever they want to you wink

Always give a clear indication of when you need to be paid by. By doing this you will have some sort of point where they have to get all their crap sorted by, instead of giving them opportunity to them for it to drag on for ever.
Some of the clauses sellers put in their descriptions to cover themselves are there to stop the buyers messing the around, even though they are not even technically legally binding... wink

He comes and collects the car within a specified time at a time convenient for you or he jogs on. Seriously.

Put a timeframe on it or tell him you'll relist it.

This is sadly part and parcel of selling a car on ebay. You are best to use a classified ad.

I'd send him this:

"I'm selling a car, not negotiating a UN peace treaty. If you're interested, come and have a look. If you're just being a pedantic tt and have no intention to buy it, fkoff."

It's turned out that the chap has...

Contacted VOSA, who have said that the unsigned emissions cert doesn't bother them, although it should really have had the right car make/engine capacity details.

Contacted the MOT station, which has agreed to do another emissions test FOC, in his presence.

Otherwise, it seems to just be pedantry. I'm being told off for wanting to abruptly cancel the transaction and assured of the buyer's genuine intentions.

Time will tell but at least we seem to have a solution.

This

I've never bought or sold a car on eBay, but I can imagine in most cases, it's just pure grief.

I wouldnt be that accomodating towards the guy, he sounds like a complete wet blanket.

I would ask him politely to come and pick up the car that he has BIDDED for or he will get the unpaid strike thing. Especially as you have already tried to sell it once, you must be getting thin on patience and also sick of the sight of it still being there!

Give him until the end of the weekend, then start all over again on Monday unfortunately....
