our son has been involved in a 3 car accident, the car in front had to stop real quick, our son stopped in time and was at stand still but was then hit from behind and pushed into the car in front, he has front and rear damage and he is 3rd party fire theft, in my day the blame always was the person behind, is this still the case or is each claim individually assesed. he was just 2 weeks from his first yrs no claims and now looks like not only will he not get that but have to pay a premium on renewal if thats how it works, and fork out for his own front end repairs any views thanks all

If he was pushed into the car infront, its the fault of the person who hit him.

im sure its still the person behind whos at fault,as is this not classed as driving without due care and attention?obviously your son was paying attention as he stopped in time.
Im sure if the police were in attendance then he can use the crime referance number for the insurance company to check on the details and statements the police took down to see who was at fault and what claim should be made, wheather that be his own or the other persons insurance.
Good luck and keep us posted on what happens.

I was always under the impression that if you are hit from behind and hit the car infront, insurance assume you were too close to start with and you are liable?

Probably wrong though.

In this instance, doesn't that rule seems a little harsh? If the car infront was a ferrari and you had a clio - the power difference in the brakes would have meant that you might end up on the ars3 of the ferrari (obviously, thats just an example i thought up smile)

You stop safely. Someone else doesn't, and its your fault? It doesn't work like that unless there are exceptional circumstances.

If he was hit from behind assessing as two incidents your sons situation is as the worst case
Single police incident number single accident there's no chance of it being said it's your fault for being too close if the car behind had hit you at 100 mph you'd have had hit them even if you had left a reasonable gap.

I hope everyones none the worse for the incident

thanks for all the sensible replies, police were called and details taken the front car driver who our son was pushed into I believe said to the police that she had seen him come to a stop before he was hit so hopefully all will be as it should, wife has just taken our son and his friend to A E as they now have neck and back pains but think they still bit shaken up. just to add the last car who went into our sons car is well smashed and a throw away job for sure so that itself will give some indication of speed etc.. we got all pics .. so now for the insurances to battle it out.. sons car can still be driven as the front and rear bumpers folded up and took the grunt. thanks all views very welcome still.

It's the person at the backs fault, same as if he had steamed into a queue of traffic.

From my experience it's going to be a real mess. Car 1's insurance company (the person in front of everyone) will claim of the insurance on car 2 (your son) for the damage to car 1. Car 2's insurance company will claim of the insurance of car 3 (the person at the back) for the damage to both car 1 and car 2. I've been involved in a 4 car pile up like this (being the 3rd car being pushed into nr 2 who then hit nr 1), and it took 4 months to sort out.

All should claim from Car 3, surely?

This happened to my son.
The insurance company of the car that ran into the back of him & shunted him into the car in front paid out for the damage to my son's car and the one he was shunted into.
No liability attached to my son and no problems either.

I should have said that I have experience of it being painless too. I was driving my mates car (covered 3rd party on my insurance), he was driving the new car he had just collected. I stopped in some traffic, mate stopped behind me and the person behind him drove straight into him. Damage to the back of his old car, front and back of his new car - all came off the muppet at the backs insurance with no issues. He had immediately admitted liability though and some coppers attended and took statements, which helped.

Do note that you will have to pay the higher premium at renewal as the case won't have settled by then. If it is ruled in your son's favour, you will get the money back then. Just a temporary cash issue ...
