My girlfriend was hit by another driver on Thursday and since then we've been trying to get it repaired and have had nothing but sh*t from the insurance company and the other companies they've passed us onto.

They were at a crossing, she was in the middle of the road signalling to turn right and the lights began to go red, she turns as she has to now the lights are turning red and the car coming towards her appeared to be stopping....but then didn't, and gunned it through the red light.

This car hit hers above the passenger side rear wheel arch, knocking the wheel sideways (so it's at an angle on the axel), and damaging the bodywork.

At the scene the other driver admitted fault. No witnesses and she was shocked so didn't think to take witness details (she's only 23....never crashed before).

Now here's where it get's fun.....

She called her insurance company, said "I've had a non-fault accident I want to get my car fixed". They tell her to call Helphire who pretty rapidly send a guy out to pick the car up, and documents to take a hire car. She hasn't signed anything. The hire docs state that she's responsible for ludicrious hire charges (£56 per day) as well as various other fees, which HelpHire say she won't pay, and they will recover from the 3rd parties insurance company.

However, in the legal docs, it says she's responsible, so I asked for them to confirm in writing that she won't pay anything - cue lots of protestations over the phone that it's a "free car"....but nothing, a flat out refusal, to say anything in writing.

The position she's in now, is that her 1yr old car is sat in a random garage in Bolton (RRG), she has no car, and everyone we try to call trys to take the work but won't confirm that:

- they're Ford Approved
- that she won't be responsible for costs

How the f*ck do you get a car repaired? Her insurance company is Hastings Direct, who seem to be utterly st and full of lies.

Take the helphire car and pay the £15 ( approx ) insurance to cover against hire charges.

Job done.

Hate to say it, but I wouldn't be so sure it's a non-fault situation. Hire car costs will be dependent on who the insurers or courts decide was at fault.

This is important....unless the other side is very generous then I could quite easily see her taking the blame...

Unfortunatly it will be a 50 50 fault . I got cought in the same situation , however I was in the main road going straight with right if way and blind bellend emerging from a side road starts to edge out then stops for 2 seconds then keeps on going . Nice brand new type r wrote off . And direct line provided me with a stupid corsa for 2 weeks only

As has been said I wouldn't rely on her being not at fault. The third party's insurance will probably get the other driver to change their story and say it was her fault.
It will be easy for them to say it wasn’t their fault as she did pull in front of another vehicle, she also has no witnesses to prove it was a red light.

Unfortunately the fact that they admitted fault at the scene means nothing. When my car was hit by an old man his insurers admitted fault and then changed their minds and denied it three times over a 10 month period before I sent them photos which proved the old boy was at fault.

Had very much the same - rear-ender on a dual-carriageway, yet the other party, after being very apologetic at the scene, decided to lie through his teeth for 18 months, then all through the magistrates court when it was finally heard (down near him, not anywhere near me! frown ), and if it hadn't been for his testimony contradicting the laws of physics* I might have ended up with it being 50/50.

* apparently I was going faster than him down a slip road, pulled onto the D-C then straight into his path. He braked twice (why twice???) and still hit me. Makes perfect sense, eh?!? rolleyes

Sounds like she'll be at fault.

She attempted to cross the road and the road wasn't clear and she drove into the path of an oncoming car.

Any "proof" that the light was red for the other driver (i.e. witnesses etc.). There is, due to location of cars etc., "proof" that she turned onto oncoming traffic.

Yes that would be unfair and it was really the other persons fault, however the law and insurance companies don't work on what's "right" but simply on provable facts and evidence etc.

Anyway, hopefully other party will stick to their honest story of running a red light.

Avoid any dealings with helphire! They told me the exact same story, ie nothing to pay etc. My solicitor told me the other day they want 3 grand from me if I dont win the claim!
