I received an NIP from Warwickshire police but unfortunately could not remember if me or my wife was driving at the time!

Now been sent summons for failing to identify driver.

Anyone got any suggestions as to plea etc?

Did you take reasonable efforts to determine the driver such as request the photos etc.? If do I would suggest you plead not guilty and quote the 'Hamilton' defence.

I sent a letter asking them for evidence so i could identify the driver and complete the NIP accordingly. They explained that it was probably a rear facing camera so would probably not be able to see who was driving!

..did you explain to them that it is illegal to name a driver if you are not certain? (perjury)
