Dangerous driving - police responsibilities?
Discussion
if the police arrest someone for dangerous driving, (an indictable offence) do they need to radio this in following an arrest, or do they just fill the paperwork in at the station? There is a very fine line legally between careless and dangerous driving (all in the definition of 'below' or 'well below' a reasonable persons' standards....). I know someone who has requested the radio transcipt for this purpose... Thanks
There is no power of arrest for dangerous driving (unless its death by dangerous).
If they were arrested for this offence it'll probably be under section 25 PACE - unable to verify drivers details.
If an arrest is made there is no requirement to use the radio.
Two complaints against the Met ? What for ? Where ?
Ditto what monster1 said really.
Also, you don't have to radio anything in for it to be legal. The radio is purely the communication to get you information to and from jobs. We give closures to jobs, they are then closed accordingly. It generally states on there that someone has been detained for whatever offence and then taken to whichever custody unit. The copy of the log is a legal document and is generally included in the prosecution file.
The custody officer dealing makes the decisions and detention is authorised by him/her.
Driving offences (other than death by) are generally reportable only, therefore no arrest for that particular offence.
