NIP dated 11/02/2004, 58 in a 40.

Asked to see the evidence, and they've sent me a lovely picture of a person who is clearly me, driving a car that is clearly mine.

Have done a lot of reading around this, both here and on pepipoo, but am still none the wiser.

Two questions:

Is this photo admissable as evidence, given that:

-- had a motor cycle activated the camera, they would not have been able to identify either the rider (as they would have been wearing a helmet) or the motorcycle because there is no legal requirement for them to have a front number plate. This is an example of "how the car driver is being unfairly singled out for prosecution".

Secondly:

If I get my friend to fill in the NIP, nominating me (not to do so, would be illegal), and no-one signs it, will it have a knock on effect on him?

I don't think there's any point in disputing my guilt, but I'm wondering why a road that is a dual carriageway coming away from a motorway junction, with no pedestrians and no schools should have a speed limit of 40?

the say that photo is eveidenc

but to this day one has never been used in a court to identifi a drive

Sorry not true, I've just collected 3 pts and 60ukp from the Hants BiB for riding a motorcycle at 38 in 30.
Got zapped by a handheld radar _and_ he photographed me front and back... There is no mistaking it's me due to the helmet design and the bike. (The bike has a top box with stickers all over)
