I sold a vehicle over 4 weeks ago. It was a private sale, the buyer drove the van, he was happy and spent a few hours going over everything etc.. I dropped £1000 off the asking price as well.

He has had several issues with the van since purchasing it and now wants compensation for the repairs and loss of earnings.

Where do I stand?

Private sale, his duty to check. If he wants a warranty, he should have gone to a dealer, where he would have paid that extra grand.

Was the vehicle sold as seen? were the problems known before you sold it? age and general price of van?

Do not offer any compensation without being clear on exactly what you are doing, if you offer compensation it could be seen as admit of fault.

He has no comeback, unless you specifically lied about something, which seeing as you spent hours going over it I suspect you did not. Tell him to jog on.

You should give him all your money, house, wife etc.

consider it a tax on not reading any of the weekly threads that crop up on this subject

Tell him caveat emptor, then tell him that you will report him to the police for harassment if he tries to contact you again.

Where do these people come from???

Buyer beware - private sale means he has no rights

If he gives you some crap about Sale of Goods Act tell him to poke it as it doesn't apply

If he tells you it's against the law to sell him a car that's unroadworthy, that's also b0110cks.

There's no case. Just ignore him.

Basically he'll threaten you with solicitors,legal action and so forth, nothing with come of it and you'll carry on with life.

Thanks for your replies.

He informed me that he has been to Trading Standards and they advised him that he can claim for all the repairs and loss of earnings. It's a catering van that I sold for over 12k. The van was listed on ebay. However, he never purchased it via ebay. He called me and arranged to view the van, paid cash and took it away the same day.

He's either lying to them, or to you, because that statement is incorrect. If it's a private sale, he hasn't got a leg to stand on.

Did he sign a receipt with "Sold as seen" on, or such like?



..does he have to for this to apply anyway??

Stand firm, it's total bks. Buyer beware on a private sale. Let him say what he likes, the SoG act only applies to cars bought from traders
