My lad just had a notice of intended prosecution, speed camera, thing is he came home and said that his car was mis-firing so I took it out for a test run. Now just so happens that the offence took place on the road that him and I had just driven on, ie. I honestly don't know which of us was driving when the offence took place.
What happens now, any ideas?

You may wish to run a sub-section (4) (reasonable diligence) defence, although, in reality, you should be able to show exceptional diligence to have reasonable chance of success.
