Just got a penalty charge notice this am - for driving in a bus lane.

Bizzare thing was I was only there to avoid all the buses which were blocking the road!

I waited through 3 sets of green lights unable to move because of a number of buses parked across the junction - don't suppose they were caught on video!

I am going to write a rather polite letter explaining the circumstances.

Just reminds me why I hate London so much.

The prohibition on use of Bus Lanes is made by an Order by the Local Authority. Is it possible to view the particular Order (copy at LA or local Plod Shop)?
It may well contain an exemption something like

" in order to prevent an accident and the vehicle then leaves the bus lane as soon as practicable"

This, from what you describe, may give you some leverage in your appeal.

is a typical such Order and for information

Round our way (Nottingham) there are a number of bus lanes, one well known 24hr one, several marked for certain times of the day, and at least one (A60 Mansfield Road, Daybrook, inbound), with no time stipulations at all. Does this lack of time signs mean that it is 24hr, 2hr, 15 minutes, only applicable with a bus in it?

Facking Nerds.

AFAIK no time markings equals full time, 24hrs a day.

Was once stopped in the bus lane cos it was empty and I wanted to turn left at the lights rather than wait in the queue with everyone else to turn right. And the BiB had parked TWO marked cars....

....on the bus stop. Bus lane blocked

Sorry for the hijack, but a quick related question. There's a new bus lane near me which has signs up (presumably showing times of operation) which are covered, I assume, because the bus lane is not in operation yet.

Am I legally allowed to use this lane as, at the moment, it is just another lane which happens to have red tarmac.

Would this be different if it said "Bus Lane" on the tarmac, but still didn't have any signs showing?

Cheers

As stated earlier the Bus Lane prohibition is by Order and it is within this that there will information as to signing.

Traffic Signs and General Directions 2002 state the
"Bus Lane Sings - blueys" are there to indicate the prohibition of the Order as is the Road Markings which can only be used in conjunction with the "blueys"

If as you say this is a new Lane being put in then could be that the Order is not yet in force and therefore no offence..

If in being and signs covered then not lawfully signed and offences cannot be prosecuted.
