Obviously if you set up a company with a name and identity very near to an established brand you can be accused of 'passing off'

If a third party does it, without your knowledge, is it legal?

Lets say a person owns a domain harrads.com

If they redirected that to harveynichols.com without harvey nics knowledge or agreement would that person be breaking any laws?

I'd imagine it would be a trading violation. Also, don't underestimate the power of big companies, who'll throw enough money at something to get it sorted out.
