Parking ticket advice please
Discussion
Hi there, just wondering what the legality was of a parking ticket I received and if I should bother fighting it.
I was coming home late on Saturday night, a couple of roads away from where I live I noticed a wobble coming from the rear of the car, I continued home as it was only a couple of hundred metres. When I pulled into my road there were no parking spaces (thanks to Brighton council randomly painting double yellow line along 10% of my road) so I stopped on a double yellow line to check the problem at the back of my car.
One of my tyres had been completely shreded, the wall was torn from tread and my rim was touching the floor. Anyway, I left my car where it was through fear of damaging the rim and then went into the house, grabbed my camera and took a photo of the tyre because I was quite amazed at the damage!
I woke up in the morning and found a ticket on the car, I grumbled, jacked it up and then took the wheel down to the local tyre centre for a refit (actually got a good deal on a part worn - normally my tyre would be £120, but I only paid £28).
Anyway, I was wondering if I could contest this ticket? Was my car technically broken down? Well no, not really, I could have moved the car and driven for 5 mins looking for a space, but this would have damaged the rim, costing me LOTS.
So, what do the fellow PHers think? Personally, I'm up for a contest with the council.

IMHO you should try it with the council, as they are all a bunch of money-grabbing twats. Especially as you've the "proof" that you had a breakdown......
I'd send a very hard worded letter to them recorded delivery with the demand for an answer within 7 working days, otherwise you will be prosecuting them for "demanding money with menaces".
The proviso being that there is the allowance in the local bye-law that a breakdown is not covered by the yellow-line laws...

The Waiting Restriction would be imposed under an Order and this will defined the area involved and what exemptions are included (could cover breakdown).
You will need to see the Order at your LA or Plod Shop to see what it actually states.
Also check the double yellow lines and ensure that at the ends they are blocked off with a line at 180. If left open then the signing is illegal and they cannot prosecute you.
Armed with the necessary information then write your letter, POLITELY (an aggresive one only gets the readers back up and no help) pointing out the circumstances and ask them under these to void the ticket.
