I have just recieved an NIP.
I was amazed to find in their fact or fiction leaflet that they claim their equipment is 100% accurate.
I didn't think anything was 100% accurate but this is moving away from my main question...

After the initial section the NIP states:
"Contrary to
Article 3 of the 70 Miles per hour, 60 Miles per hour and 50 Miles per hour (Temporary speed limit) order 1977 Section 89 (1) of the Road Traffic Regulation Act 1984
and Scedule 2 of the road traffic offenders act 1988
and Scedule 2 of the road traffic offenders act 1988 EC04"

Is this a standard section of an NIP or is this section intimating that I was in a temporary 50 miles per hour speed zone?

The road in question is a 60 miles per hour speed limit (they clocked me just as a 70mph duel carriage way went back to 60mph single carriage way - sneaky) and there was certainly no temporary speed limit there, I now have photographic proof of this and multiple witnesses to support that fact.

Basically if this is a standard section of the NIP I'll just return it as requested and take things as they come after that - but if they are intimating that the road had a 50mph speed limit at the time I am going to be as awkward and difficult as possible and fight it all the way.

Any comments, suggestions or thoughts would be appreciated - and of course a simple answer to whether that is standard on an NIP would be quality too.

Yes I had the same wording on my NIP. Didn't really understand but I guess it was for doing over the 50mph temporary limit on a dual carriageway that is normally 70mph. Very confusing!

This is the legislation which set up what we all call NSL.

sounds like a temp limit to me. If there is no signage, tel them to **** off. In legal speak.

FiF is correct. The legislation was originally introduced as a temporary measure during the oil crisis in the early 70s.
It covers all non motorway NSLs.

The Temporary Speed Order sets out the various limits to be observed but doesn't say it is an offence.

89(1) RT Reg Act states that it is an offence to exceed the limits in the Order but doesn't give any penalty.

RT Offenders Act sets out the penalty.

Simple innit? Or as FiF would say - Yorkshire logic
