Need input from the PH masses here. A work colleague of mine is looking to transfer her Spanish license to a UK one now that she is settled here and has a full time job. Here are the facts:

She has held her full Spanish license since October 2004
She has a permanent residential address in London since end of February this year
She has a full time job with a bank

Now the bad bit....

She tells me she has served a 1 month ban for drink driving in 2009 yikes

According to the UK.Gov web site she can apply using a D1 form from the Post Office which entails a £50 fee, passport sized photo and documentary proof of who she is (passport etc). All well and good if I am reading this right.

The two things I am not sure on are:

Does she needs to be resident in the UK for a certain period of time before she can apply for the UK license? (some UK "benefits" require you to be here for 6 months before you can apply for them)

Will her ban be shown on her UK license as the offence was not committed in the UK? (not a great scenario but if it can be got round it will)

For clarity the ban does not show on her Spanish license (unlike our ones) but is held on a databse so that it comes up whenever her license is checked. The concern is the loading any UK company would put on her insurance quote if this information was revealed.

Key question is will the offence committed and served in another EU country be placed on her UK license or will it be issued "clean" ?

I'd hold on to the Spanish license for as long as the law allows, which is three years from date of arrival in the UK.

It'll come back clean, surely?

The offence codes won't exist on the DVLA database so it's hard to imagine there's any practical way a foreign motoring conviction could be shown and it's not even as if there's an equivalent to a 1 mth ban.
Also the limit is lower is Spain and presumeably she must have been not far over to only get 1mth?

In theory I suppose she should still tell any company she applies for insurance with, but they don't seem to able to deal with anything not covered by a UK offence code.
