No, it's not Will Smiths Phillipino Equivalents Member.
It is, my car...
Unfortunately in Tesco's car park, whilst driving out to go home, my girlfriend and I got reversed into but an unobservant <insert expletive>.
After the crash he seemed perfectly amicable, however his first words upon exiting his vehicle were "Where did you come from?" (how can you miss it?! I thought) explained that it was a company car and gave us all his details being rather apologetic.
However, we get home and give the insurers a call only to find that he's claimed we're liable as we were reversing at the time, which we weren't!
So the whole thing gets thrown up in the air...
My Girlfriend is heavily pregnant so we need the car in case she needs rushing to hospital which she did after the incident to check her and baby over to make sure everything was okay since we'd suffered quite a jolt.
She decided to phone up TESCO and ask if they had any CCTV footage of the incident, the man on the other end of the phone seemed happy to oblige and was willing to help stating that he would check each Car Park facing camera within the approximate time slot the accident happened and call her back should he find anything.
I felt that asking him to check all cameras for a limited period rather than the correct camera for a longer time span would more likely find our accident and provide difinitive evidence of who was at fault.
I went to TESCO and asked the security guard if there would be any chance I could assist in the CCTV search. I was told a store manager would be sent to see to me. She subsequently arrived with a moblie in hand looking flustered, asked me my problem which I duely explained...
"What time did this take place?" she asked.
"About 8:45"
"Oh, I've got someone on the phone here also saying they had a crash around this time, I think someone's trying to pull a fast one...
... who hit who?"
"He crashed into us..."
"He? I've got a woman on the phone..."
"Well that's probably my girlfriend who was with me in the car at the time"
"Well in that case, We don't disclose such information without request of the police, you'll need to inform the police"
Chuffing brilliant, I'm sure they've better things to attend to.
Thoroughly miffed over the whole affair:
The initial crash,
The claim that we/I was in the wrong,
The damage to the car,
The unhelpful and dissmissive attitude of the TESCO's manager...
There's lads in the car park who wash cars for a nominal fee, I had thought one of them would make a good witness... but they neither talk, nor understand, english...

Unless you were doing a handbrake turn at the moment of impact, I really can't see how the damage on your car would prove you caused the accident like he claims.
From the pictures you've posted, presumably with your car still positioned as at accident, it's clearly his fault.

Dear Sir/Madam,
I wish to make a request under the Data Protection act1998 ,to be given a copy of video/fixed photographic stills and images recorded by your store in....................... ......which have images of myself.
on the ............(Date)at approximately .........am/pm
This is my right under section 7 of the act,principles 1/6/7.
Please forward me a copy of your request form,which shows your process to obtain this,in compliance of the act.
I give you 40 days to comply,and enclose the stat fee of 10.00.
I will be requiring a copy of images that include myself,on VHS Video/VCD/DVD format,since this is the only means I have to view it using my own equipment.
I understand that a data controller,can refuse to provide a request,in the absence proof of the subject being supplied.
To comply with this requirement,I enclose a copy of my driving licence/Passport (delete as app)
and also a copy of a recent utility bill to confirm my address.

Will the fact that I'm probably unable to be seen in the footage until I get out of the car after the accident still entitle me to access to the footage involving the crash?

surely you wont need the cctv footage anyway? i would've thought the damage speaks for itself, i can't think of a situation where reversing into the side of someones car could possibly be the other persons fault?

Didn't need his services directly, but he was very helpful and knowledgable, as well as being a top bloke!(or +1, if you prefer).
He hasn't got a leg to stand on, as the damage doesn't correlate. There's a clear photo of his car in the bay, and he should have been paying enough attention. Even if you were reversing, it was your right of way. Therefore... he gets boned. Also for lying!

Make sure you obtain the images correctly! I thought I was fortunate as when someone reversed into my car and left without leaving any details. The car was in direct view of a camera and I knew the security guard who looked after our cameras so he sat with me while I looked to see which car had caused the damage. I took some stills and reported it to the police, they advised that unless the stills had been obtained with consent they where useless (I don't know for sure if this is strictly correct), they did however obtain the footage and pay a visit to the person in question.
She then tried to get the helpful security guard sacked for gross misconduct because he'd shown me the footage. So that's why allot of places will be very reluctant to even let you see the footage.
