Who's at Fault??
Discussion
Ok, picture the scene, stationary in traffic at a roundabout, car in front moves off, you glance right to check its clear, then look forward to see they have STOPPED just after the line on the roundabout even though the roundabout is clear, you slam on and collide with their vehicle at around 3MPH.
Is it still my fault even though she stopped on the roundabout (after the line) for no reason, and suddenly?
Fairly sure her brake lights were not working either...
Not f
king happy, just nicely building up my no claims again after I was hit and they were taken off me.

Always move into where you can see it's clear, rather than where you assume it's clear.
Sorry
If it was only 3mph the damage can't be that bad, so get a quote for settling it away from insurance companies.

buggar, i thought it would be that.
She has said she will get a quote for not settling, I did a bit of scaremongering about her insurance going up if she claims (mine did when i got hit up the back end) so hopefully wont be too bad, one of these vans with a wheelchair ramp though so not the usual repair job sadly!
Took me 5 minutes to persuade them i actually had insurance!? WTF?

Your fault.
Whatever the reason she stopped, you failed to see there was a car in front of you.
Any damage?
I didnt fail to see that, i saw them set off on a roundabout.Whatever the reason she stopped, you failed to see there was a car in front of you.

Damage wise ist cracked my numberplate and popped the bumper off, from what i could see its cracked the plastic cover on the wheelchair ramp and possibly the bumper bits at each side.
Suppose if i do go through insurance companies i get a new bumper and numberplate so not all bad!

I am assuming you didn't drive in to the back of another car on purpose?
It is irrespective of the fact that you saw the car set off; from this situation your correct actions should have been to pull up to the give-way line on the roundabout with your eyes looking ahead...THEN look for a space in traffic once at the give-way line.
No brake lights? Stop for no reason? Roundabout?

I'm not sure from what you said that it is that dodgy. But we all need to be on our guard. There's a white saxo driving around Wolves with no brake lights that'll stop for no reason. Not so good at it though as the few people who've mentioned it all stopped before hitting him.

Another 3 feet, would have been a horn blast and a gesture for stopping in a stupid place!

I was at the give way line, they were ON THE ROUNDABOUT, I saw, i braked, i almost stopped.
So not only did you drive into a stationary car, you drove across a give-way line into a stationary car. You're not making this look any better for yourself you know.
It's an easy mistake to make, but it's also clearly 100% the fault of the car behind.

That one did cross my mind, especially as when i got to the car they were all clutching their necks, but when i offered to call an ambulance they all went oh no its fine and from there on were looking round and fine.http://www.telegraph.co.uk/news/uknews/law-and-ord...

Given the speed of the impact, no whiplash, heck id be happy just to swap my numberplate!

Normally drive across give way lines, there there to make me give way to traffic from the right, not to stop me, that would be a stop line.

I know its a common accident, ive seen it happen at t-junctions and roundabouts, usually people behind not slowing and expecting the car to move, of which i am careful, but i stopped, they stopped, they moved off, i moved off, they stopped, bang!

No, they're there to make you give way to all traffic on the other side of the line. Gassing Station | General Gassing [Archive] | Top of Page | What's New | My Stuff
