Car Parking Tickets

Where do I stand???

Parked my car as I do every morning in the car park next to the train station. I buy a monthly pass and leave the ticket on top of the dashboard so you can see it through the windscreen. Returned to the car, to find a ticket on it, £50 if paid within 14 days, £80 if paid in 28 days. Now I always put the ticket on the dashboard before I leave the car, however this particular day "it must have slipped off".......

Feel a little bitter, that I have been hit with the fine, when I park there everyday, in the same space and have done so for the 3 months - I've sent a copy of my receipt showing that I pay for a monthly car park pass and I'm hoping on good will??? (Yeah right) Do i bite the bullet and pay, are there any other options available?? With the press about clamping etc, I'm hoping I may be able to wheedle my way out of it, the cost of the parking is bad enough, coupled with my train pass and the ticket - just crazy!!!

Don't give in to them. If they don't overturn the fine, ask for proof that they couldn't see the ticket.

If they can't provide a photo then demand that the ticket is overturned.

If they do provide a photo then stick the fine back on your windscreen, put the parking ticket on the dashboard and send them the photo.

They'll back down.

this I like...... have already asked for photo as yet nothing arrived & my 14 days expire this thursday which means fine increases.

No, normally if you appeal the 14 days is frozen. I appealed and 90 days later still paid half the amount.

Similar thing happened to my mum a few months back.

She had parked in a disabled bay at ASDA, my gran has a disabled parking permit.
She had it in the car, and she and my gran went into ASDA but forgot to display the permit.

She had a ticket when she got back.
We sent a copy of the disabled parking permit away and asked them to prove that we hadn't displayed it, etc.
They never got back to us...

Just a joke isn't it, hit with the fine and that no converse with you again. Well i've still heard nothing, so will take no further action until I get a response.

Depending on who runs the car park as councils have different legislation but all the operators can claim for is compensation i.e the cost of the bay for a day. They have no legal right to fine you.

Do a search on here as there have been lengthy threads re this before with pro forma letters to send to operators basically to tell them to see you in court . Legal beagles on here suggect these guys are just bluffing.

But wait till your'e heard back from them. I got off one for exactly the same circumstances.

You need to find out if the car park is council or railway run, or privately run. If private, then the ticket is nothing more than an invoice, and pretty much unenforceable unless you make any admissions. Also the invoice is based upon a "loss" the company must show they have suffered, and as you have a permit and have paid for it, they cannot show a loss.
