Roundabout accident (help)
Discussion
Apologies if i posted in the wrong section.
My GF had an accident and want some advice please. She was approaching a roundabout on a dual carrigeway and was in the left hand lane with left indicator on and turning left, she exits the roundabout to the left and stays in the left lane (another dual section of road) before signally right and moving into the right lane. BOOM, collides with a car that was behind her. The car behind moved into the right hand lane immediately after exiting from the left lane and failed to notice my GF indicator and manouver. The only fault I can see my GF made was no lifesaver check. Is it 50/50 or the other drivers fault for an aggresive illegal overtake lol?
I hope this makes sense.....

As I understand it, your girlfriend exited a roundabout onto a dual-carriageway in the left lane. After she had left the roundabout, she indicated right to move into the right lane of the dual carriageway in order to prepare to turn right at the next roundabout. At this point she hit a car in the right lane of the dual carriageway?
If that's correct, I'm having a hard job of seeing it as anything other than 100% your girlfriend's fault...

Tbh i do that a lot (move into the right hand lane straight away) to get past, a few times i've seen people begin to drift across as if they are going to also move into the right hand lane but they've always seen me before proceeding with the move. It's hard to say without seeing the exact situation but if she pulled out on someone who is already in the right lane then it's her fault imo.

Is it 50/50 or the other drivers fault for an aggresive illegal overtake lol? Don't see how it was illegal, some people may say aggressive but I suppose it depends on your demeanour.

I would say her fault unfortunately. I hope this makes sense.....
I disagree with the above on the basis that it is not clear as to which point on the dual carriageway she performed the 'move into the right lane'.
If for example the change in lane was fairly immediate after the roundabout then that is fine, it is more than likely her fault - however the other factor is speed, how fast was the card behind approaching? There is little to tell whos fault it is without other factors described further.

doesnt matter how fast the other car was going. If for example the change in lane was fairly immediate after the roundabout then that is fine, it is more than likely her fault - however the other factor is speed, how fast was the card behind approaching? I had exactly the same situation accident a few years back, although i was in the 'other' car. I came straight off the roundabout into the right hand lane, other drive went into the left lane and then immediately indicated right and moved into the side of me without checking his mirror.
It was a very clear cut case and went through without problem, as it was clear to all that the other driver had't checked their mirror or blind spot. Your girlfriend will be found liable i would expect.

I can see how in a very special circumstance it could go 50/50. If she began to move before the other car was along side her and he was going much faster than her, before he or she could react he'd be along side her and they'd collide.
But we don't know if that happened and neither would the GF I expect.
ETA: If damage is a combination of rear and side, the insurers would go 50/50 no?
