Girl cycled into car, admitted responsibility - What now?
Discussion
My girlfriend was just driving out of the house and a chaps daughter cycled into the side of her car (basically she was going too fast and could not stop in time).
Her dad was with her and the kid admitted fault, but the dad is trying to say his insurance will not be required to payout. He said "Get an estimate for the repair and I'll see if I can pay it".
So is it true that his insurance will not be required to payout? His kid was cycling on the pavement (which I thought was illegal anyway...) and the damage to the car is scuffs down the front bumper, dent on the front wing and several scratches
The guy claims to be an insurance broker so I can see this been a f
king nightmare
She has only had the car a week and it *was* immaculate

Correct me if I'm wrong but even if liability is admitted, unless she is insured then the only way you won't end up paying out for any damages is if they stay true to their word and pay up. I've had this issue recently with a pedestrian and it burnt a nice big hold in my pocket.
Short of suing the child (well, her parents) for negligence.... So yes, if the bloke is saying get a quote and he will sort it out, then get some quotes, it will be far, far easier for you in the long run...Bowskill said:

How fast was the pedestrian walking?!If he says he has no money you will probably claim through your insurance and try to recover the costs through your uninsured loss recovery if you have it.
Snag is you loose NCB and will have to pay excess.
Uninsured loss then trys to get them to pay up.
In my experience when a 13 year old lad hit the side of my car I lost my NCB, and paid an excess, uninsured loss recovery pissed around for 9 months then said they couldnt recover money from the lads parents as they were poor.
Just get a kid to do the same to his car and then dont pay;)

If the girl was on the pavement or the road it sounds like it was her right of way...Again is it worth notifying the police in case her retard father tries to make out his little angel was injured by a "speeding car" ? ie get the facts to them before they receive a possible lie?
Just worry because the world seems full of scum who are out to get money for nothing and accept responsibility for nothing

Oh cool, so if I ride my cycle down the pavement at silly speed and hit a car that has stopped (hopefully his), I can claim off them for whiplash etc?
Unfortunately.. yes.Edited by Bowskill on Sunday 5th September 18:50

Still, the girl was on the pavement and from what you describe the car driver pulled out into her path? I doubt the bike was exceeding 30mph, esp since you don't mention the girl being injured. So why should so 'pay out'? Sorry, this is my view from the information supplied.
