Hi,

We are in the middle of purchasing a 'new' house.
The house was built in 1989 and is being sold by it's second owners who purchased it in 1991.

Everything is ticking along but in the disclosure documents they have mentioned that there was a boundary dispute back in 2003.

The information they have supplied indicates it is not related to the actual house or garden but an area of common land that used to be at the back of the house. It looks like the owner of the house at the bottom of the garden has now 'taken' ownership of this land and has added it to his garden.

They say the dispute was settled with the agreement that the neighbour would plant shrubs to shield the back of the house..

Firstly I guess is there anyway to find if this is true or the dispute has be settled ?

Secondly as the house boundary has never moved, is this just a disagreement that happened many years ago and has no relevance.

Our solicitor is away for a week so just wanted to bounce it off a few people before I speak to him.

If it's common land then it's not yours (refer to title deeds etc and look for a plans with a line round the area/s.)

If Neighbour wants to pull a flanker then it's his call I'd have said. Mind you who 'defends' common land I don't know.

Land Registry should have the definitive answer (that's where solicitors look, but there's no reaosn why you can't approach them yourself)

Thats my feeling.

At the end of the day all he has done is to extend his garden so no it runs along the back of our 'new' house.

I am thinking they were not happy with this, but at the end of the day I'd rather have a looked after garden than a mess of 6ft of common land.

I guess the previous owners took exception.
