Hi all. A quick question (best suited to you legal types I think!
I was involved in an accident around 6 months ago- including another vehicle, which recieved very little damage. My car took the brunt of it trying to avoid them. Now, my insurance company sorted it all out, as they do, decided it was 50-50 liability, went off on my merry way.
A couple of months back I recieved a letter from the Third Party's insurance, saying that the claim was still unsettled and demanding payment of the other driver's excess. Called up the insurers, sent the docs off to them for them to sort it out.
This morning I recieved a County Court Summons, saying that the insurer of the other party wants to take me to court for the excess, plus court fees and legal expenses. Of course, I've sent all the docs off to my insurance company who are adament that they'll resolve the issue, but I'm worried- I'm aware that a CCJ against me could ruin any future chance of me getting credit.
Any advice?

After a few days call your insurer and confirm they have received the summons.
Make sure that you keep a note of the time and date and who you spoke to.
If anything now goes wrong you can advise that you instructed your insurer and they are to blame.
Might be worth speaking to your insurer's legal department and ask what you should be doing.

Technically you are liable for the claim, however your losses and those of anyone else are subrogated to your insurers.
It's an old trick used by pedantic insurers and Uninsured Loss recovery firms to try to scare you. You've done the right thing and it will be resolved by your insurer.
Any judgement entered into against you will be set aside by the court in no time anyway ie removed without trace.
