Bought a car with an under-reading speedo

I have just bought a 2001 2.5 V6 Jaguar X-Type. I will pick it up later this week.
But on the test drive I noticed that the speedo under-reads!
With the speedo reading 30mph, the car felt a bit too fast so I turned on my TomTom - and sure enough my real speed was 37mph!
Most cars I've driven have over-read, so at an indicated 30mph they were really doing 27ish. So there's quite a big difference there.
The tyres are all the correct size.
What else could be causing that?

Does the ABS work?Does the dash always read ~7mph over the actual speed, or does it always read ~23% over the actual speed?
Worst case, the gauge is faulty. Would probably require a whole new cluster unit on a car like that, unfortunately.
Say you were caught speeding, and "were not aware of the speedo issue", would you have a leg in court. If you could show your car indicated that you were not speeding, would you get off at least once claiming you were not aware of the issue? I mean before the days of satnav, how would you know?

No. The onus is on you to make sure that you are not breaking the law. You might manage to sue the car maker for damages, I suppose.Perhaps you could ask in the jag section or on a jaguar forum how the speedo works on a 4wd X type. Matbe it has had a replacement diff from a 3.0 litre and the ratios are different.
Sounds like it might be one to be wary of, or at least insist it is rectified before collection. Have you thought about having say a RAC inspection done on the car for piece of mind?

Why on earth would anyone test drive a car with an obvious issue (with no idea of what is the cause or what will fix it) and then still agree to buy..... no offence but it just seems daft But on the test drive I noticed that the speedo under-reads!
