Car Warranty Issue

Involved in a dispute over a warranty claim.
The warranty covers the car for 3 months or 3000 miles, whichever comes first.
The receipt for the car shows 0 miles instead of the mileage. The dealer is saying that because the car was in for some work at a network dealer the mileage was logged but this was a month before we collected the car.
I can't remember what the mileage was when we collected the car.
Has anyone got any ideas?

The dealer is trying to use the mileage logged at the network dealer as the warranty start by the sounds of it which seems suspicious to me.
The car has done over 50k miles so a few more than zero! I pulled out the receipt to check the mileage when we had the problem with the car to see what it was when we collected it and thats when I noticed.
I've checked the dealer website and it lists AutoProtect as their warranty provider. I've tried phoning them to see if I can pull up the details for this car but haven't managed to get through yet.

Sorry should have been clearer, it's the sales invoice that states 0 milesin which case, complain that the car you received was not the same as the car on the invoice and you want a car with 0 miles please.

Just out of interest, how many miles have you actually travelled since the work was done at the network dealer? 3050? 3100? more?
I guess you could point out that the they wouldn't expect you to accept the date that the network dealer carried out repairs as your 'start date' so why would you expect to accept the mileage recorded at that point? There would have to be some kind of reasonable allowance. If it was just sat around on the forecourt though I wouldn't expect any more than perhaps the distance from the repairing dealer plus 50 miles.

Depending on the fault and value of the car, they do not have a leg to stand on. Warranty or not warranty you have your statutory rights...
Car was 15k, repairs were £570ETA Professional opinion of the specialist was that this part would have started to deteriorate 10k miles ago

In which case I would think you would probably have a fairly good chance using your statutory rights as mentioned above. This says that any fault (such as this) pre-existing when you bought the car is the responsibility of the seller (proportionally in some cases) for six months irrespective of mileage.
It is actually longer but the onus is on the dealer to prove you are wrong in the first six months which is the crucial part.
Consumer direct would be able to help you with this if you want to take it further. Of course the garage probably won't see it that way and realistically you can only expect a contribution as a likely outcome.
