Guess this is the right forum for this as its train related.

I commute to work using Southern trains, and if the train is more than half an hour late I can fill in a form online and they send me vouchers. Its a fantastic system and I have had around £50 in vouchers in the last 3 months with 2 claims outstanding!

However does anyone compensate Southern? For example yesterday a lorry hit a bridge and the line was shut for several hours and therefore all commuters who were trying to travel are entitled to compensation equal to a days ticket. So will SOuthern be able to claim off the lorry driver? Equally on occasions when the delays are caused by over running engineering works do Network Rail pay the compensation?

Also do any other rail companies have this instant compensation scheme?

Whether you get "delay repay" or compensation in the form of a free ticket or a 1-day refund against your season ticket depends on when the franchise was last awarded on your particular line. Recent franchises such as First Capital Connect operate delay repay, whereas its predecessor, Thameslink gave automatic refunds to all season tickets based on the severity of the delays.

When there is a delay, the corporate lawyers slag it out to apportion blame, but usually in the case of "infrastructure failure" such as broken rail/signal failure/bridge strike etc, Network Rail foots the bill by reimbursing the TOC (Train Operating Company). Where the delay has been caused by the TOC's own equipment such as train failure or unavailable driver, it has to foot the bill itself.

TOCs like delay repay because most people can't be bothered to claim and any delay under 30 minutes doesn't qualify, plus there are lots of ways they try to wriggle out of paying. For non-season ticket holders, delay repay is better because you are compensated for any journey where the delay is greater than 30 mins but for season ticket holders, they can be delayed by 29 minutes every day of the week but will receive nothing.
