When driving at Christmas time I hit the mother of all potholes which scuffed up my front wheel and dented the rear. I had to buy an new rear and will need the front refurbishing at the very least - I am roughly £450 out (fitting, wheel, geo etc). I have bills which tie in, a witness and the damaged parts.

I have written to the council 3 times now and to date have only received 1 reply - stating they were going to look into the inspection records for the road and get back to me. I have heard nothing since - despite a friendly reminder.

Any ideas what I can do next - how do I stand legally etc? Another letter? If so, any idea what I could quote to get the ball rolling faster?

I am in the same boat, my friend. Only to the tune of £1200.

Its a shame you didn't get photographs. I have a full set - which I sent in to the offending authority. They tried to deny anything had happened!!! They "lost" the evidence pack I sent TWICE!

Here's what you do.

Build up an evidence pack complete with photos (if you had them), statements, reciepts the lot. Photocopy EVERYTHING you ever send to the buggers at least twice and file it so if they try it on you have what you need. Make a formal complaint (I believe you have, haven't you) and a claim. They have insurance and can settle with you - which they will want to do rather than admit liability in court.

If no joy then a solicitor's letter followed by Small Claims Court proceedings.

I am about to do this myself.
