Hypothetically - if a car is under warranty for 3 years and should be serviced at 12k miles or annually.

Say it was registered on 1st Sept 2008

1st service at 12k miles on 1st May 2009 (ie 4 months early)

Next service at 15k miles on 1st Sept 2010

Is it still under warranty?

Or does it have to have been serviced by 1st May 2010?

Fangs.

I'd suggest it should have been done in May. Most service schedules state which ever comes sooner of x months or y miles.

Correct but a lot of(but possibly not all) car manufacturers take the view that parts not directly affected by servicing are still covered. Ultimately if your gearbox fails or the ABS ECU packs in, changing the engine oil wont have made a blind bit of difference. If how ever you have an engine component or a turbo fails then, they are very likely to tell you to take a running jump.
