was anyone else screwed by the closure of dream machines a while back? my report from the liquidaters says there was quite a few people who like myself lost money. yes i admit i went to them and went for the good old sale or return, i lived in a flat and lost my parking space for my cerb ( long story ) so needed to get rid of the car quickly. anyway , much money paid to soliciters and lots of whiskey drank, the cerb was lost and i had to pay off the finance !! and 'there was nothing i could do' said my expensive soliciter! just wondered if anyone else out there was in the same boat ??
you couldn't make it up A similar thing happened to me about 10 years ago when Team Central went belly up. They sold my car on and the money disappeared. The new buyer bought it using finance from another company. That finance company were legally obliged to ensure that the original finance was paid off so that they could have free title. They didn't and so my finance company went after them and they ended up clearing the finance.
Worth checking to see if your car has been refinanced because if it has, you may be able to reclaim the finance from them as they don't have title.
If you have cleared the original finance, then you have title to the car not the current owner or finance company.
BTW my finance company actually advised me on this route. They had to threaten them with legal action though but it got sorted.

I agree that it is not a happy situation but we have dealt with the position presented to us. If I can provide any more information, please contact me - details on the report.
Davel: have you been affected by the liquidation? If you have been and have any comments about my conduct as joint liquidator, please contact me so that your concerns can be addressed. If not, I suggest that there has already been enough speculation about events prior to the insolvency of the company.

I cannot comment on who has title to customers cars. It is a complex area and I can only recommend people to take their own advice as they see fit.
The law is there, whether it is sufficient or easily accessed is another question, one that would be very difficult to answer as you would have to consider what resources the taxpayer would want to commit to the issue.
Davel has not yet replied so I will give him time to say why he feels that we have somehow "failed" the creditors in this case.

i did recieve the new owners address with all the information my soliciter obtained, i had been tempted to drive past there, maybe i should, and just take the car back, apparently you can do what you want with other peoples property these days!rich

If you buy a car that was stolen the police will take it and give it back to the rightful owner,
OK the new owner looses out but someone will inevitably loose why should it be the original owner?
And why the hell is the Thieving git at DM not inside chasing soap around the shower room floor right now? or at the very least picking up his teeth with broken fingers

The car wasnt stolen,you had a contract with DM to sell the car,it was legal for them to sell the car. It was legal for the buyer to buy the car and they are therefore the rightful owner, you have no claim on the car.Its not the new owners fault or problem.
The bit that failed was passing the funds to yourself because they declared bankruptsy. You have to deal with the administraters along with whoever other crediters are on the list for a percentage of his assets(which would include your funds),if no assets then no payout.
I would take some advice,you might be able to take a civil action .....
