erratic engine idle after cold start

i have a 2006 x5 e53 with an n62 engine.rough idle misfire faults after cold start. date of manufacter is may 2006.this specific problem should not affect the year the car was produced yet..... crankase replaced 2x and throttle 1x.now according to my tech ad at bm, the valvetronic intermediate levers need to be replaced.and if this fails...it would require a new engine. anyone else with the same car prod date and year have the same prob? honestly it's not up to us the consumer to have to pay if it's a known fact for bmw that this is clearly their respnsibility.defective parts....i have this car since 10/2009 and it's been nothing but trouble
