ET hearing next week

Quack!

I have my ET hearing next week, for my previous company putting me on gardening leave then refusing to pay me,

What should I expect? Iv been given the date and the location, i have exchanged documents, the only thing is I have 13 days notice - the CMO I have recieved says that 21 days before the hearing I need to tell the other side how much i will be claiming, and 14 days before I need to excahnge witness statements - will this be a big problem that im inside the deadline?

That is very short notice of a tribunal. What was the date of issue on the date of hearing letter? Have you received the paperwork that the other side has to disclose?

You need to exchange the paperwork now, and notify the claim for loss of earnings etc asap. If there has been no delay in the receipt of the notice of tribunal date, and you really have been given such short notice, then a quick note to the court to explain the reason for the late exchenge/notification of claim amounts would help.
You don't want to be seen to be disobeying the instruction of the tribunal, they don't take too kindly to that, and the other party may wish to use it against you.

We had a previous date of the 23rd of Feb, send to us on Jan 25th, but the other side applied to ask for it to be put at a later date because one of the witnesses would be on holiday (they provided proof of it), and I recieved the email from the ET an hour ago, and the file is dated as of today.

Until you recieved notice of the new date you should have assumed that the original date stood and sent your bundle off. Why didn't you?

It could be a problem but as most tribunals are biased towards the employee they will probably make allowances if you ask them, though they can be difficult to contact and deal with.

Unfortunately the UK IT service is one of the Uk's most badly organised public functions, good luck.

Within an hour of the other side complaining, the judge had sent round a order saying that the date picked would be changed, and another one would be announced. I thought that meant I could wait until the new date, I had no idea. I still hadnt received anything from the other side too.

New date in 2 months time, aparently the boss will be on holiday again with his family and is begging for a postponement

3rd postponement in a month - will the judge grant it? Lets wait and see folks.
