They hit me but are claiming whiplash

Hiya its my first post here and its a bit of a long one so well done and thanx if u get to the end and reply
My other half was out and about in his van when someone drove into the side of him they had come over a stop line at traffic lights to cut it pretty short the bloke is now denying responsibility and now claiming whiplash ive have repaired the damage to that van but had it assessed before hand i also took pictures ive been chasing up insurance company and the most i can get off them is they are waiting for the other side ive also had a previous taxi drive into me and after my insurance company saying they would come and look at the van to see there was no damage they did not turn up and then paid out anyway without telling us there was no damage and the speed was about 2 mph as it was moving from been parked and the taxi was parked on a corner on double yellow lines i could do with some help on this as it is a false claim and i can not afford the insurance to go any higher after loosing 25 yrs no claims its more than high enough thanx to the taxi driver

Let your insurers worry about it. If you have photos, they're hardly going to accept you slid into it sideways. Unfortunately, until the other side accepts liability, it will be treated as a fault claim and if the taxi driver "disappears" and they can't trace him, it remains forever "your fault". Just deny liability - they will only go the knock for knock in less obvious cases.

brilliant response for the OP, what is the point of comments like this? OP sadly as already said you will have to wait for the insurance companies to battle it out!

It doesn't have to be word perfect, just punctuated. Try reading what you wrote and place a comma where you breath, a full stop where a sentence ends and perhaps a new paragraph where a new direction in your story turns. It will make your post easier to understand for advice to be given.

They do this when they deem it 50:50 ie no independent evidence. Why? Because £1000 is usually grabbed with both hands by fraudsters and it costs more in legal fees to fight it so it's damage limitation. Who get the blame and pays forever? You do.zippyprorider said:

Whilst you may have been the OPs white knight and powered through that massive block of text, lots of others would have taken one look at it and thought 'Nah'. Those people may well have otherwise had good advice for the OP. If he wants to get the most out of this place he should at least present his query in a way which is easy for the people he wants help from to read. No one expects a proofread masterpiece just a few full stops and paragraphs. OP sadly as already said you will have to wait for the insurance companies to battle it out!

Seems a pretty common occurance A friend of mine was hit at some traffic lights he was a passenger in the car he thought nothing of it but a few weeks later the other cars insurers paid him £1000 not to claim for any injury when he had no intention of anyway I guess you cant do a lot about it apart from maybe taking legal advice if you have it with your insurance were there any witnesses?
