i just bought a car from a dealership and done an on the spot part exchange with my own car , i had a private reg on my own car and the dealer promised to do the turnaround but he needed me to send him a copy of my new tax disc and a cheque for £80 and the actual new keepers slip i got when i bought the new car. im a bit worried because he says he hasnt recieved these even though the royal mail tracked service shows they have been delivered and signed for . also the car was sold with a mot up to feb 2012 but when i got home the one he had given was to march 2011 , i have asked him about this and he seems very disinterested , needless to say he has the documents for my old car but can he sell my private plate and wot can i do about the mot .. is he trying to rip me off...

If you have transferred the ownership of the car to someone else then the rights to the plate have gone to that party too.

You can pretty much kiss the plate goodbye. The only thing that may help is if you have something on the reciept saying the plate isn't included in the sale but that isn't guaranteed.

When changing my car I've always made sure the change has happened before I pick the car up. Or transferred the plate off myself before the sale. I don't trust dealers not to mess it up, it's only a plate and it's not a high value one but it was a present from my parents for my 21st so I dont want to loose it

As soon as you transferred ownership of the car (with PP attached) to the dealer, it was his plate, my guess is that he's either done a deal to sell the plate or sell the car with the plate . . . in which case its very likely you won’t get it put on a retention and passed back to you.

Dealer keeping the plate may be unethical, however unless it’s in your contract that he needs to put it onto a retention for you, your stuffed (a quick google of this site, will show you that this question pops up every week or two)

As for the MOT, check online to see if the cars MOT is out next month, if so and his advert or your receipt states it’s MOT is until 2011, write a nice but polite letter advising the dealer you will be reporting him to the trading standards and will be taking him to the small claims courts to recover your out of pocket expenses.
