PHers,

I've had contact from a chap who'd more than likely want my car today. We've been in contact over a month or so but no 'deal' was brokered. I'd therefore kept my private plate on my car.

Said buyer rang me out of the blue this morning saying if he had £xxxx, would I do the deal today. The offer is acceptable smile He's from Scotland and I'm in the South West so he'd be flying down this afternoon.

Problem now is the reg docs. Having downloaded the V317 retention file, it looks like I've got to send off the V5 and MOT cert with the filled in V317.

Can I still sell him the car and him drive away with it having paid? I assume I'd have to write a receipt of sale stating that'd he'd be responsible for any speeding tickets/motoring infringements etc he may incur whilst the docs and being sorted by the DVLA?

Don't take the risk. Get the plate transferred/put on retention before selling.

In future when you decide to sell a car start the retention process at that point so you can avoid this problem.

You may be able to go to your local DVLA office and do it sameday. Plate on retention, new V5 with original plate, go to halfrauds and have plate made. Job done.

Going through this as well.

Last time we didn't have any trouble, seller was prepared to wait.

However the story this time is that buyer wants the car as a wedding present by the 12th.

I went to our nearest DVLA office with the docs and paid the retention fee on Monday morning (the day after buyer said he'd have the car).

Today, the new MOT, tax disc and retention cert' arrived in the post, so at least buyer is not driving away with our private plate.

What worries me is that the DVLA say the V5 will follow within 4 weeks!

So we are also considering getting the buyer to sign something that they are responsible for any speeding ticket etc, as we cannot transfer him as the registered keeper without a V5

I am not comfortable with this, but it's a sale.

I don't understand why the V5 lags behind the other docs? ?

Thing is though, just as your as RK for a while longer doesnt mean you are liable for fines etc. Police wise you would be liable to tell them who was driving the car etc if it same to it (s72 ?).

Also, with him in Scotland and you in England, you'll have a good alibi !

Thanks also for the other helpful posts. I'm going to suggest we make it sometime next week, prefrably when we can both go to the DVLA office and get it sorted there and then.

It's the wife's car, I don't think I'll ever bother with a private plate.

so you've never 'tested the water' with your car? I know i have, not 100% sure on selling it, but would if the right offer came along. Also an 8 odd year old 540i is hardly going to fly off the shelves at the present time.

Steve if you've agreed on a price, get him to send a small 'holding' deposit?

I wouldn't worry about it. Sell the car, give him a receipt that states the plate is coming off & sort the paperwork out.

I've bought two cars in the past and driven around on the previous owners plates for a fews weeks. Once the new tax disc, V5 comes through I'd fit the old plates back on and send the private ones back in the post.

This.

And next time sort the plate before you put the car up for sale.

FWIW DVLA seem to be ultra quick atm. I had my plate on retention and Dove House put it on my car the Moday after I paid the deposit and by the Friday I had the V5 before I had even picked the car up smile

too true, but when a buyer comes along they're hardly going to wait around another couple of weeks while the present owner tits around sorting plate retention paperwork

I had the car in the PH classifieds for about a month. I took it down having had enough of timewasters, so technically my car wasn't still up for sale. This chap is very interested/made a good offer this morning hence why I've now got to get a move on.

Batty is right - it's a bit of a narrow market for V8 motors at the moment, especially older ones like mine.
