Simple question for the employment lawyers on here.

Can someone have a a case for constructive dismissal if they have not been working for the employer for under 12 months?

I've done the usual google searches but am not really getting a clear answer - or maybe I reading it all wrong!

"If they have not been working for the employer for under twelve months" . Is that what you really meant to say? The qualifying period for claiming unfair dismissal is twelve months. There is no qualifying period for claiming wrongful dismissal (that is, dismissal in breach of contract).

I meant - have worked for the employer for under 12 months.
