Who's duty is it to pay back the emergency tax I am owed?

Hi,
I am going to be filling in P46 at my new job, which I start soon.
However, this means that it is likely that I will pay too much tax. Is it the duty of the employer to pay me back the tax I've overpaid (when they get the correct code), or is it my duty to contact my local tax office and take it from there?
I've contacted the local tax office over tax matters (paying too much etc), and at times they are very slow so I don't want to go down that route again.
Also, what is a "personal allowance" in tax terms? This year's personal allowance is just over £6k, what does this mean? Furthermore, can an employer request a P45 from my previous position(s)?

Sure Eric will be along, but this is as I have dealt with it previously, on direction of HMRC.
Emergency tax code, deduct at rate given by HMRC until coding notice arrives. Continue deductions at rate on coding notice. Provide P60 at end of year.
Ultimately, it is your responsibility to seek reimbursment for your tax, although a considerate employer will assist.
Your tax code is a tax free allowance. So this year it is £6475, you do not pay take on £6475 of your gross income. You then pay income tax on the amount above this.
ETA: Why do you not have a P45 from previous employer? Are they delaying unnecessarily? If so, contact HMRC directly.

If your new employer submits the P46 quickly, your tax code for 2010/11 should be adjusted before 5 April 2011. If it is, the PAYE calculated by your new employer should automatically correct for any tax overdeducted in earlier periods.
If the correction isn't done by 5 April 2011, you may need to make aseparate submission explaining the situation to HMRC.

It took them 18months to get my file.

This weekend just gone, i had two tax calculations in one envelope.
One for 2007/8 which showed a £500 underpayment, and one for 2008/9 that in total showed that even with the underpayment, they still owed me £300
God know's how much tax i'd paid that year to end up paying that much over, i know i was on a T code, whatever that is.
Cheque came today
It took them 18months to get my file.

When I've been on emergency tax its always been automatically corrected in the next months salary, as I understand it this can only be done within the tax year - so if you earn for March and are emergency tax you will need to sort that out with the tax office directly. If you are still on it in April they can correct that in May.
