ok....do you own land or ground (freehold) all the way down to centre of the earth....if not how far underneath the surface.

no i am not thinking of mining or tunneling to oz.

Just a thought after too many beers last night, i think there must be a certain depth.

All the way, but you don't own the mineral rights.

I'm not allowed any form of open-cast mining, or allowed a fairground in my tiny garden according to my deeds. smile
I'm still intrigued why someone put those clauses in.

I decided to dig for dinosaur bones, got down a couple of feet and had just seen what looked like one, when my mother came and stopped me. But I was only about 7.

I don't think so - he never gave an explanation. He did joke that he was tunnelling into a bank vault but by the time he got there it had been turned into a wine bar.

They will be historic covenants passing with the land, and hence enshrined in your deeds from when all around was fields. Probably.

Not necessarily true - it depends whether the mineral rights have been reserved in a previous sale. In cases where there is no (obvious) potentially economic mineral present the surface and mineral owner are often the same.

The Crown has nabbed anything worthwhile by statute!

Worth reading this interesting case, answers all the questions posed I think:

There's still a lot of valueable minerals out there that the Crown haven't got a hold on. The Bocardo case ceratinly caused quite a stir in parts of the minerals industry. Imagine if the original case had been allowed to set legal precedent and everybody with a mine or borehole beneath their property could suddenly claim 'compensayshun'.

Yes, your right, I 'thought' the Crown had more rights than it does, but according to Google! it's still only oil, gas, coal, gold and silver.

Don't know. But if you do anything significant I expect you'll need various permissions, planning at the very least, depending on the purpose of your hole! And if it looks dangerous I expect building control will be poking around and condemning your works.
