Conveyancing - Can we use same solicitor as our buyer?
Discussion
Hello
We are selling our house privately to a friend of the family and were planning to use the same solicitor as them in order to speed up the process however, the buyer was advised by their estate agent that we couldn't do this as it would be a "conflict of interest".
Is this correct, surely the solicitor should work in the best interests of all parties involved?

It is possible to use the same company,we did this when purchasing this property.
But two different people in the company had to do the work,I could not get a definite answer when I asked if the search results were shared and therefore each side paying half.Although it would appear the sellers search had been conducted 3 months prior to ours and had to be done again.

Same here when selling some land, the buyer was paying both sets of legal costs so wanted to use the same co to keep costs down. It was just 2 different people doing the actual work.

As above - you can use the same company, but two seperate solicitors have to do their own work independantly. And don't think it speeds the process up or saves money, they still 'send eachother recorded delivery letters' (or whatever their called now) so will still charge you and the other party for doing so, despite the fact that they are further from the post office than they are from eachother in most cases!
Did this with my current house and we completed in 9 weeks (pretty quick really), but the only reason we didn't do it in 3 weeks was because the solicitors took forever pulling their fingers out and communicating.

The EA is correct, there is a conflict of interest and the solicitor would not act for both parties. We are selling our house privately to a friend of the family and were planning to use the same solicitor as them in order to speed up the process however, the buyer was advised by their estate agent that we couldn't do this as it would be a "conflict of interest".

You can use the same firm but not the same solicitor.

In the mid '80s I was involved in a project to provide solicitors with a PC based system. I investigated conveyancing as one of the things to be added to the system. One story the show how fast the system can be. Iit involved a robed gentleman arriving at Heathrow early in the morning with a bag full of money. Later the same day he left with title deeds for the property he had seen and bought. Everything was done on the same day. It just took a number of people to ferry paperwork about.FlossyThePig said:

Life is easier if you have a large bag of money....Also you don't have to have any searches done if you are buying with no loan....
