tThe issue is the upper rear wing element. The rules say ‘the local concave radius of curvature may not be smaller than 100mm,’ and both cars breached that.
The rules concerned is new for this year. The test is conducted with a template and would not have come to light until after the race because not all FIA tests are conducted routinely every weekend.

Reminds me of 2009
"Toyota drivers Trulli and Glock started the Australian Grand prix from the back of the grid after being excluded from qualifying in 2009.The rear wings of their TF109s were found to be in contravention of the rules limiting how much they may flex."
They escaped with just a penalty.
I think over the years the FIA have made The rules so complex it’s very easy to either misinterpret something by accident.
And it can't help Sauber’s cause that their car's were quickest through the speed trap in qualifying.
So they were probably found to have been given a performance advantage.

“Certainly this has not lead to any performance advantage. We are checking the design of the parts now to better understand the situation and we intend to appeal the decision made by the stewards.”

It could well be enough - I think this would interfere with the way the DRS works (with a smaller radius the top element would lift more than is allowed at its edge, letting more air between the elements) which could be worth quite a bit in qualifying, and still be useful in the race.davepoth said:

Well, the commentators did mention just how fast the Sauber was..... He finished what, 10 seconds in front of Kobayashi? Wonder what difference this made to his lap times.
