520D Anti-Syphon Flap / Folding Rear Seats

Am new to this forum, and I'm sure its been covered, but I cannot find the info, here goes..................
just got a 2008 520D M sport touring, and can't get fuel in without it pissing all over the place. It seems the anti syphon flap is stuck closed. What is the best way to junk it ????
Also, it seems a crazy question and I have looked through the book, but do the rear seats lift up so that the cargo area is flat (like the volvo I have just sold) or is it always tilted up ?
Apart from that it seems good car.
