Hypothetical situation...

You are caught in a speed trap and sent a NIP. You return said form having filled in the "someone else was driving" section with Mr X's details. The scamera partnership then send a new NIP to Mr X. Mr X then returns the NIP saying "It wasn't me".

Assuming you and Mr X stick to your guns, what happens next?

Cut-throat defence. Both should be summoned. RK for failing to supply driver details and purported driver for speeding.

But with what evidence? Mr. X may be lying.
That said, I am aware of such a case in which a corporate RK was charged under such circumstances. The RK won, i.e. NG.

There is no evidence of speeding against Mr. X. The RK's form is not evidence that Mr. X was the driver at the time of the speeding. The RK may subsequently give evidence to that effect if he was there, but the form itself isn't.
