Evening all

a while back i asked about where i stood about my car going into the back of a neighbours car when the handbrake went.

since then my neighbour has done nothing to enquire about the costs of repair, and in that time, another car has gone into the back, in the same fashion as mine, im not there, im back at home for easter, but ive been told it has happened on good source.

im unsure what situation i stand in now. im currently of the mind:

The fact a seconding incident in the same area of the car has occurred renders it impossible to categorically tell what damage my car did and what car the second chaps car did. There is a photograph of the incident, but there has been no 'review' by any workshops so i don't believe this could be used as a 100% fact.especially as the photograph is showing purely cosmetic damage.

i feel very cautious about accepting damages now other than what was clearly on show last time, which was some small dings in the boot and a scraped rear bumper (which i have bought a replacement for him).

Your thoughts please?

i cant see how any damage (other than the scuffed bumper) can actually for pinned into me without question, as the other dents or structural damage (if there is any) could well have happened from the 2nd incident, not the 1st!

ill give the insurance company a call tomorrow, see what they say,

Weaselling out- it's what separates man from the animals (except weasels, obviously).

So the OP is happy to pay for the damage caused by his car and has already supplied a replacement bumper, but doesn't want to pay for subsequent damage caused by a third party.

How is that "weaseling out"? Please explain.

Looks like your neighbour is a serial handbrake cutter...Don't worry, there will be another 'accident' next week

that pretty much sums up my position, i think its a valid point of defence. im going to contact my insurance company to get advise and go from there, but i would really expect them to say the same thing as this.

i shall go from there smile
