freelander 2, unlock button opens tailgate aswell :(

we've recently purchased an 56 plate freelander 2, the problem were having is when you unlock the car the tailgate will also open, were not pressing the tailgate open button as well as the unlock by accident. so does anyone know what it could be? maybe some setting you have to change? anyhelp would be appreciated as its bugging the crap out of me espeacilly when its peeing down
