Company car question

We have recieved photographic evidence on a speeding issue but it doesnt show at all who is driving. The vehicle is a company van so what would happen if we cant positively id the driver. I have heard that the co secretary will get the points and fine. Is this correct?

Apologies if it has been answered before but I couldnt find anything.
