Ok before you all judge me as scum who choses not to insure there car please listen to first.

I was driving just round the corner to my mates earlier in my missues car and stupidly didnt put on my seatbelt and got pulled. he got me in the back of the car awnsered the usual questions about whos car it was etc and when he did the insurance check it came up as insured in my partners name with her dad as a named driver which isnt right and i asked him to phone the insurance company at this point he said he believed me and it may just not have been updated he gave me the fixed penalty points for the seatbelt and a producer for the insurance and let me on my way so when i got home i checked on her insurance and it is indeed on her and her dad.

This has happend because 2 years ago it was her and her dad on her insurance then they renewed it automatically and took money from her mums bank with no notice anyways we kept the insurance that year and added me to the policy but when it came to renewal time we cancelled and shopped around in the end they were still the cheapest so so phoned back up and asked to renew the policy and it seems they have renewed it to the original policy with her dad on and We have failed to check this properly.

Now im not daft and know me and my partner have to take responsibilty for not checking as ultimatly its our responsibility but i never intended to drive without insurance especially for the last 5 months with my son in the car.

I guess it was a blessing in disguise really as i could have had an accident or even killed someone and i would have been up the creek without a paddle at least i now had chance to rectify the situation with no real harm done.

So anyways i have gone to the police station to explain the situation and he has filed a report but said it will be down to the officer who stopped and gave me a chance to explain my side under caution. does this mean theres a chance they will be more leaniant with me i have no previous and no points on my licence.

Might have been wiser to get onto your insurance company and get you added pronto and new documents sent out, then take these to the police station. "Lost them and had to get new ones printed".

Are you not insured 3rd party on others cars through your own insurance (presuming you have your own)?

If not then its 6 points and a £250ish fine. You will be able to explain the circumstances in court.

They may be lenient if you have a genuine reason for not having insurance. In this case though I think you had adequate chance to check.

If arranging over the phone, the insurance company will always read back to you what has been agreed, and you will have been sent your insurance certificate either by post or email, which will again confirm who is insured.

I think you may just have to take it on the chin. Probably a few hundred £'s fine.

I've no idea about whether they will be leniant or not. But do you have cover to drive other cars with the policy on your car? If so I would expect you could produce that.


I have some sympathy with you on this, although you really should have checked the policy document. Last year I borrowed my mum's Swift when I was between cars so she added me to her insurance to keep me legal. A week or so later the corrected policy document turns up and the insurer (both of her cars are with the same insurer) had only got and insured me on her Discovery instead! So if I had been pulled over in that week I would almost certainly have been done for driving without insurance!

Wouldnt that be pointless as the updated docs would show a start date after the offence?

I still reckon this is the greatest number of uninsured drivers on the road - those who thought they were covered but aren't.
Continuous Insurance Enforcemant is somehow supposed to stop this?

Youre on for 6 points if uninsured
Your only hope is that your insurer's policy says it covers partners by default which sounds unlikely

Thats kind of my point. If it was as easy as ringing up the insurance company after the event, then the motor insurance industry would be much smaller! I just dont think its doable, or advisable to even try - I like the think the Police are not that dumb.

I don't get why anyone would drive without their seat-belt on? OP says it was "just round the corner" but it was presumeably too far to walk.

Police arnt that dumb, but CPS are thick as st.

Had an african woman drive into my bike a few years ago, her fault etc, she had no insurance at the time. When the police let her go, she went home and got insurance. Ambulance chaser I went with queried with insurance company, said she started her policy at 8pm, whereas the accident she had was at 10am, so they wouldnt be covering the claim.

Sent the letter to the police officer handling the case, he forwarded onto CPS. When the trial date came up for DWDCA, I asked the prosecutor about no insurance, she said "Oh we wont be prosecuting her for that, she has suffered enough".

The purpose of continuos insurance Saab is in line with the RTA to cover innocent third parties. This would mean at the very least they could claim comp under the RTA act or article 75 with the insurers having to pay out to the third party even if not liable. They then would seek recovery from the driver at the time if they weren't covered.

In this case it really is unfortunate that documentation wasn't checked and likely to be 6 points and a fine as mentioned earlier. I doubt CPS would offer anything less and the copper will have to bring the charge forward if no cover can be prsented as a result of the producer.

Insurance docs show the exact time which the cover was requested so no way of getting out of that in this way which is a good thing.

Third party indemnity on your own policy would provide cover but most insurers have stopped issuing this now.

yes they have, check the motor certificates.

i know of AXA and Aviva stopping this in recent years and they are both major insurers.

It is not seen to be good practice any more.

Cheers guys as i though really take it on the chin..... im not covered by my insurance policy as i was 24 when i took out the policy and the company only covers other cars when your over the age of 25 i did ring to check.

and agree with the pointless and fraudulent although i did ring and correct the policy straight away so im now insured i wont be using this to take to the police as it will clearly state the time and date of change on the new documents.

And yes its my fault for not checking but will my partner get in trouble for consenting for me to use a car in her name without proper insurance and dont tell her this but its her policy and id have thought she'd have checked frown i always check my policy which incidently also covers her to drive my car.

im with aviva and im covered to drive other cars 3rd party, specifically asked and checked the docs when they come through
