It doesn't sound much more complicated than them charging the wrong offence, which I would guess is usually spotted before the accused is tried.
So why not go back and charge with the correct offence (assuming) there’s enough evidence to support it?

I know it’s a question you can’t answer but what are your thoughts / gut feeling?
Put the st storm to bed rather than prolong it?

I don't know directly, why they have decided this, but it would almost certainly be unfair.

She was charged with the wrong offence, and probably arrested for the wrong offence. We tend not to (And shouldn't) except in very serious cases, allow (Awful Americanism) "Fruit of the poisoned tree" A wrongful arrest, even in good faith is a wrongful arrest and people deserve to know what they are being arrested for and what they are accused of.

However far more importantly here, charges can be decided and even changed throughout the process. But she was charged with and convicted of an offence, for which she should have been acquitted. This is through no fault of her own. If, in these circumstances, she had been acquitted in the first place, there is almost no way a court would allow a second bite at the cherry, with another offence, but the same facts.

The statement says they declined to start an alternative prosecution.

I'd imagine they judged she'd been through enough with the 2 days on remand etc. Seems a fair decision and the point has been made. The tone of the statement from the ACC upon conviction suggested the police didn't want to resort to a prosecution in the first place.

I read somewhere she was also convicted of a fare-related offence. If that's true (it may not be) then there's also that element.

I know your comment wasn’t aimed directly at me but my highlighting of it in that particular case wasn’t to suggest the contrary. If it was I would have explicitly said so.

I think as this crisis drags on there will be many more mental health issues to deal with, throughout the population.
I suspect you are correct.

Chaps, did Hancock day something tonight about driving to a place of exercise? Was it along the Lines of ‘5 minutes is acceptable’?

Cheers all. Asking for a mate who lives close to Watergate Bay and wants to go surfing.

I'm fairly sure he said it was ok to drive to a place of exercise on Question Time.

Whether that would count as a defence I'll leave to others/brothers.

Is this the thread where people seek advice for bypassing the lockdown?

no? Oh well hehe

My girlfriend has decided to break up with me.
She lives 20 miles away (I’m central London) and I really need to have a face to face conversation with her to try and salvage things.

Am I best trying to go up there by overground/train or hire a zipcar?

If I get stopped I’ll have no valid reason other than pulling at the Police’s heartstrings, or pretending she’s sick and I’m going up to do some shopping for her.

Yes, I need to grow some balls

Guess that depends on how fast you can drive and how far.

No, let it go. Decision has been made. Hard to take but time is a healer.

I’d say choose what your heart tells you to. If these any doubt in your mind about going then don’t; a relationship you need to think about saving probably isn’t one to try to save.

But if your heart says go then just do it, go. I’d say take a Zipcar. If stopped say you’re going to get shopping for her or somesuch.

She's already got your balls, in her handbag. Ignore her, she should be chasing you. Why would you chase her? Man up and be manly. Let her know you're dating. Ignore her and lets see how long it takes for her to call you. If she doesn't then you're spared the wrongun. :-)
and a life being under her thumb!

I would take the hint that it could be the end of the world and she doesn't want to spend it with you.

Think of the children!

If they go door to door without stopping then there is very little extra chance of transmission involved, especially if neither of them have symptoms and employ SD and hand washing etc.

Thanks - forwarded to him. The advice is perfectly clear, a short drive to take exercise is perfectly acceptable.
