Man awarded £24k after police officer fabricated evidence

i was surprised to read PC Burch received no punishment at all..
Ryan Fleming, 33, said his life had been destroyed by false allegations made by his neighbor, PC Stuart Burch, when he lived in Tennyson Avenue, Southend, causing him to become homeless and even lose custody of his young son.
He has now begun to piece his life back together, but said the money could only go so far.
Speaking exclusively to the Echo, he said: “The last four years has left my life in tatters. The payout goes some way towards replacing the material things I’ve lost, but in no way will it ever repair the damage it’s done to my sense of trust and my mental health, not to mention what it’s done to my son.
“It’s too little, too late. There were times when I didn’t want to be here anymore and, over the last four years, I’ve taken a couple of overdoses because I just couldn’t see a way out.”
Four officers broke into Mr Fleming’s home on the night of August 6, 2009, following an argument between him and PC Burch a few hours earlier about the volume of his music.
He was arrested and charged with a public order offence before being released on bail terms prohibiting him from returning to his three-bedroom home until the case had been dealt with in the courts.
Three months later, the case was thrown out at Southend Magistrates’ Court, which labelled the officers’ evidence “neither believable nor credible”.
In 2011, the Independent Police Complaints Commission later found PC Burch had changed his story from initially telling officers he was in fear of his life, to telling investigators he had called the non emergency number because there was no threat to him.
However, in the run up to his court appearance, Mr Fleming had been made homeless after being evicted from his council house due to his bail conditions.
Left with nowhere to go he and his son, who is now ten, stayed at his mother’s and brother’s house and even a caravan in Upminster before mental health charity Mind provided them with a bedsit in York Road, Southend.
At one point Mr Fleming lost custody of his son to the boy’s mother, though this was later split between them.

Stuart got jealous his wife face booked me and said I can't come round as much as Stuart is feeling he is having to compete for his family." I understood and left them to it. Then Stuart started having me arrested threatening me being horrible to my son. On the 6th of August I found out in s paper an old friend had died abroad, John. I went home and began working out I got a knock on the door from leah (stuarts wife) asking me to turn down music at that point I saw Stuart stood in his garden mocking me. I approached the fence and told Stuart if he wished to carry out his threats here i am otherwise duck off I then went back into my home and turned the music off. Within I think it easy 2 hours I had 4 constables beating me in my own home.

A very long story, but I helped a friend have a case thrown out of Carlisle Crown Court after a two year ordeal. He was accused of breaking a mans leg in an unprovoked attack outside a pub one night. My friend has no criminal record, but did have issues with a couple of the local bobbies after they did little to protect him on a couple of previous occasions he was attacked.
He wasn't local, but I know all the others involved, being a small, Cumbrian village that I'd lived in for 20 years.
Over two years I managed to estabish;
1) The Police didn't get the CCTV from the pub in question, that would have shown the incident, despite there being no evidence it wasn't working that evening.
2) The Senior Investigating Officer failed to get CCTV from the pharmacy outside which this happened, instead admitting in court that he made up that it didn't have CCTV.
3) Inventing a story about the CCTV from the hotel across the road not having CCTV. I not only found it was untrue, but I got hold of copies of that nights CCTV which disproved almost al the witness statements against my friend
4) My friend made a 999 call whilst on the ground being attacked. The Police said there was no record of it ever being made. They maintained this until day 3 of the trial, when it mysteriously appeared, more than 2 years later
5) My friend maintained he wss attacked, grabbed in a headlock and pulled to the ground, and it was during the fall the leg was broken. The break in that case would have been an obvious spiral fracture. The Police failed to get the medical evidence and refused to do so for 18 months until ordered by the court. Low and behold, the x-rays and medical reports all stated spiral fractures.
6) The police refused to forensically test the shoes my friend was wearing against the trousers of the 'victim', despite having seized both at the time of the incident
7) Having produced the missing DVD of CCTV from the hotel across the road, the CPS response was to ask Cumbria Police to investigate me for perverting the course of justice.
8)The local Police and the pub landlady outside which the fight happened, colluded in 2012 when questions started to be asked and she got dragged in to court hearings, to report me for Harassment, which went to court last year and was dismissed. The idea being to warn me off.
The whole incident was an massive eye opener from start to finish and lots more happened which would take a long time to type out. Lots of Police misbehavior. It hasn't removed my trust of the Police as a whole, but it has removed any notion that they should be trusted any more than any other branch of society, which as sad.

You would like to think so. But I've been involved in police internal disciplinary hearings where the officer was either a genius who invented a time machine or was lying...... His punishment? Nothing. It was a "mistake". Was it f**k.Involved in a complaint now actually. Interestingly, the Police have been as unhelpful as possible. My view is that as complaints are initially dealt with internally, by the so called Professional Standards Team or something very similar, who are either outright liars or simply incompetant and there you have the problem.
They will happily lie, distort, and even ignore the law. On more than one occasion I have been informed, in writting, that they did not know what the Data Protection Act was! I then recieved a call telling me that the Police are not bound by it. I simply agreed, asked them to put it in writting and ended the call - thay have not yet done so.
Sadly, while many of the Police are very good, there are a number that are not and becuase the complaints process is internal, you have almost no chance of a fair result. You can always go to the IPCC - a more usless, gutless bunch I have never come across!
Want to take the police to court? Well, it is not as easy as it would appear as the courts seem happy to allow the Police to break rule after rule on evidence which requires a good knowledge of the law to deal with. Not too many years ago the Police took me to court for speeding on the M25 saying it was restriced speeds due ti the weather yet they failed to produce a picture from the speed camera. I produced a report from the Met office stating that the weather that day had been nothing but war sunshine - the reverse of the polices sworn statement to the court. I got off obviously but the Police were not given so much as a warning despite totally, blatently, manufacturing "facts".
Sadly, what was once a superb service is now rife with issues and they bleat on about public trust?! Want our trust back - then start to behave, stick to the law, and being in a complaints service that is not utterly corrupt.
Sad really as only a year ago I thought that those who complained about the police and accused the of wide spread lies and corruption where part of the tin foil hat lot. Sadly it turns out we have a very corrupt Police force with a distinct lack of honesty.

I was pulled over not too long ago and asked to produce ID, as was my passanger. My passanger pointed out he was not required to produce ID and they in fact had to justify the stop at all. They offered to arrest him for resisting arrest, which he had not done. They said if he did not have his passport on him they could arrest him, which is simply not true. I decided not to get involved - seemed a bit pointless. He may be French but as a rather well respected lawyer in London it was great fun watching him steam-roller them!
The public here have very little understanding of the law and the Police play on that. Not convinced most of them know the law either.
I do think most of them do a great job, honestly and well, but the moment you have an issue with the Police, they behave like utter bullies and the fact iot takes guts, education and frankly money often to deal with them is utterly wrong.
