A 4x4 has been "abandoned" outside my house for 3 weeks or so now. It's not causing an obstruction, but is parked half on the pavement. Its roadtax expires the end of this month, and no-one's been near the car in the last 3 weeks.

Is there any way I can "claim" the car for myself? I'm sure I remember reading some obscure law where the owner has to reply to something within a certain timeframe. Maybe I'm just getting confused. Do I have any options, apart from removing the petrol cap and calling the police? smile

Maybe they've gone on holiday, leaving their legally parked vehicle in a place where nosey neighbours will keep an eye on it.

Is the pavement obstructed, could you get a wheelchair/pushchair past? If not then BiBs could have it towed.

Yup - you can claim an 'abandoned' car.

There are a few hoops to go through though.
you need to;
- demonstrate that you have taken all reasonable steps to contact the owner
- inform the local BiB of your intention
- inform the local council of your intention
- fill in a form for the DVLA (can't remember the number)

The various peeps try to contact the owner, then eventually it's yours. You get a v5 etc.

whilst I was admiring the key artwork some low life had created on the passenger door of my BMW this morning a guy, who last month moved into the maisonettes over the road, popped over - never seen him before

found out it belonged to him, I explained to him that the car had been there for 5 weeks and the council had been informed as I didn't know it was his

all sorted

Did I miss something? What right did you have to believe a taxed, parked car was "abandoned"? Do cars have to be washed regularly, or even driven regularly? I'm not only lost, I'm at a loss.

I think the point was it wasn't taxed......

the clue is in the thread title wink

I waited 10 days after the R/T expired before I contacted the council to remove it - therefore I had every right

seemed only fair to give the guy a chance to recover the car before I dealt with it smile

I was under the impression that the car is never actually 'yours', and that you would just become the new registered keeper. And also that the rightful owner would be entitled to claim his/her property back at any time, and even be compensated for any wear and tear caused by you using it.

  • Waiting to be told that I am completely misinformed* LOL

Err, I think the point was that it was.

Unless I've missed something, this says it expires at the end of this month.

OK, apologies to all. I'm afraid I was responding to erdnase who had talked about a car that was still taxed. I couldn't see any justification for even thinking about that one.

sleep envy, as the OP, obviously had a different car in a different situation. "The car" wasn't the same "the car" throughout.

Sorry to confuse!

Have you reported the car to the BiB??

The police, specials and PCSO's now have powers devolved from DVLA to remove untaxed cars without warning

The force I work for regularly remove cars which are untaxed. Call the police (using the local non-emergency line!!!) and report the car. You should have all the details - Make, model, registration (so we can check if it is of police interest in the first place), location and if anyone has been to it.

If anyone is available they will be dispatched to the location and one phone call from the scene to DVLA and a decision will be made to either remove it or place a CLE2/6 form on it (not sure what that is)

If it is of interest to the police i.e. stolen then we will remove it anyway.

Long and short of it is - call the BiB and let us take care of it in the first instance.
