Got a nip in the post this morning from a road where there is a scamera and a van regulaly parked by the side of the road. I pass this spot a LOT. Sometimes 6 times a day in the course of work. Both camera and van positions are engrained in my memory and are obvious for all to see. There is NOOOOO way I would have gone past either at 36 mph (30 limit), even in my sleep whilst dreaming I was driving a GT40 or whatever that was invisible to all forms of speed detection. Obviously will ask for photographic evidence, wont sign etc, but at the moment I am so sorry for reading posts simillar to this and not feeling more sympathetic. I will stop and have a conversation with the operator of the van next time I pass it, but doubt it will do any good. Mean time, any advice for me when I finally calm down ?

You got done for 36 in a 30 did you?

In my force you'd have to be doing 38mph to be done....

Anyway...once you've got the photograph and it's plain for all to see...sign accordingly, send in your licence and your payment..and then learn from it...

Thanks but there is as I said, NOOOOOO way that I was doing 36. Absoutley NOOOOO way. I know this location like the inside of my wallet. I always obey the limit here. a) cos its a built up area and b) cos its got a camera and a regular van.

Anything is possible...I know where the cameras are in my area too and when I've driven past preoccupied in the past and found myself a mile further up the road thinking...'christ, I hope I went past the camera under the limit'...we all let our attention slip sometimes....Being human, I'm told..

Streetcop, you dont seem to be reading what I write. I know that every time I pass the camera and van on this road that I am whithin the 30 limit. I never have to think " shit I hope I wasnt over 30" cos I go down this road so many times a week, I know camera/van,traffic lights, side turnings, pedestrians etc, didnt happen, Nooo Way.

The same reason why my force doesn't prosecute drink driver's until 40mgs of alcohol in 100mls of breath, yet neighbouring forces prosecute at 35mgs. Depends on each individual force...

You can of course always contest the charge. This would normally mean sending back the NIP and waiting for the fixed penalty. You would then ignore it and wait for the court summons.

You then plead not guilty and seek disclosure of all the prosecution's evidence against you.

That being said, I wouldn't send back the NIP straight away if I were you. I would go to www.pepipoo.com/NewForums2/index.php this website and find out my options.

PePiPoo is the best site on the web for drivers wishing to find out their legal rights. Do nothing until you have checked it out as it apparently has a high success rate.

Thanks to turbobloke and De Molay for the link to pepipoo, gonna check it out tommorow. Honest guys, more chance of driving into my garage without opening the door than speeding in this road.!!!

So what is the point of having laws then? If its down to an individual officer or authority to decide if to 'nick' or not, effectively making their own 'law' as they see fit.

Thats not what the law is for, nor is it showing any respect for democracy or the law makers. I dont see how any officer or authority can have the right to decide not to enforce 'the law' on their own wim.

I have also read loads of advice on here about how to behave when pulled, how you can get off if pleasantness itself, and how you are guaranteed to be nicked if you have an attitude. But surely it shouldnt make any difference, the law is supposed to be impartial, you have either transgressed, or you havent. WTF should your attitude have to do with it?
Likewise, what difference should the county you are in have to do with it? I thought the law was National and we were all equal before it.

Bit of a random thread this one. Youve been fined for speeding, you have proof that you were but you claim you werent and decide to be rude because street tells you this.. Sort it out man!

Absolutely everything...

1) The police officer at the time has the power of discretion, in most incidents. If you act like an arse, do you think he/she is going to use their discretion? NO, me neither.

2) IMO, there is no need to issue a fixed penalty on every occasion that someone commits a minor motoring offence. Often a few words of advice and a little telling off is all that is required to get the safety message across. However, if the person isn't accepting of that and has an 'attitude', then perhaps the only way to enforce the message is to hit the person in the pocket £££.

I thought the above 2 paragraphs would be obvious to everyone and generally welcomed??????????

You cannot of course. You are entitled to seek recourse through the judicial process. That is your right.

It is unfortunate however, that the partners in a lot of Safety Camera Partnerships are the Magistrates courts, which will hear your case.

Hardly impartial...........
