If you have the phone in your hand then it is using a mobile while driving.
If you are streaming audio and it is in a holder then it is OK. If you are streaming audio and you hold the phone then it's using the phone and is unlawful.
If it is in a holder and it is streaming video and angled towards the driver then it is unlawful as you can't have a tv in a car that the driver can watch while driving so that is unlawful.
The police don't need to try to make this unlawful because it already is.

I think he means live streaming from the car, i.e. streaming your journey? Even though I can't imagine anything less interesting than someone wanting to watch my daily commute, but I think it's more aimed at the "Periscope" type "look at me and what crazy stuff I'm about to do" types.The police don't need to try to make this unlawful because it already is.
How would this effect some of the top end dashcam type stuff that stores to the cloud? Plus the police would also need another specific exemption written in for their own streaming stuff?
I agree with the assessment that the dangerous aspects of this are already illegal.
Other than the potenital consequences of a world proliferated with live streams from cars, I dont see why it should be illegal to live stream from a car.
Dangerous driving is already illegal.

Sorry i should have been clearer in my excitement of posting in this section.
Basically people are live streaming themselves driving and basically copying what the fat comedian is doing in America with his sing-a-longs. You are getting either solo people doing it via their phones or 'families/multiple people' with the passenger filming.
No road is shown, just the people.
in one bit they said one driver looked at the road for a whole 12 seconds out of a minute while he streamed, another said he almost run someone over on a crossing as he was looking at his feed/phone while streaming.
Im not normally one that thinks social media should be used to prosecute (im thinking of the youtube hereos here) but this is different (to me)

Sounds like Careless Driving or Inconsiderate Driving to me (aka driving without due care and attention), and they're helping us by providing the evidence.

We seem to be turning into morons and this seems to be a hideous glimpse into the future.How long before we're live streaming our whole lives like some hideous spawn of Peep Show without the internal monologue or wit and Facebook/Social Media on acid mixed with the Truman Show without any production values. People will watch other peoples lives and aspire to them without realising the futility or irony. Why have a life when you can watch the life of someone more interesting? Unfortunately we have alot of that with the trashy follow around a 'celeb' programme. Or is that what you meant as your intellect is above mine and im having trouble comprehending your point.

In that case if the camera is mounted the video can be used for evidence in dangerous or careless driving.
I've seen a lot from motoring journalists and on the TV.

So if plug my phone into my car and stream music from Spotify or internet radio or TV audio, I'm ok. Unless I hold the phone to skip a track or adjust the volume. Although if I download the Spotify tracks to my phone first, I can hold the phone to change tracks or adjust the volume.
If I play a cd or listen to the radio or listen to the in car TV, I'm ok. Even if I touch the in car stereo to change a track or station or adjust the volume.
I can watch and listen to in car TV, or make a hands free call while the car is queuing in traffic, but I can't hold a mobile phone while queuing in traffic.
And if I can control my plugged in phone via the car stereo without holding the phone, I'm ok to do that.
Makes perfect sense. To someone.

No. If you hold the phone and change a track while driving you are using it while driving so unlawful. Greg66 said:

Yes you can do that while driving.If you have an accident while doing it and evidence shows that led to not being in proper control then that can result in a conviction.

It is very simple.
If you are driving it is unlawful to USE a hand-held mobile telephone.
A hand-held mobile telephone is clearly defined in the regulations and in summary is a device that is capable of 2-way communications while held in the hand.
Some say the law is complicated becasue USE is not defined. Yes it is, here it is from Dictionary.com:

In full summary: If it's a mobile phone and you use it in your hand while driving you have committed the offence. Simples.
