My prick of a brother got caught. Blew 104 (and he was still standing)...prick.

Clean license, stopped for plate light out, be as rude as you like (prick) how long a ban will he get. The pricks a mechanic....prick.

How long can i say to him he'll get roughly? (w****r)

12 month ban is standard for 1st offence IIRC. Endorsment stays on your license for 12 years.

DUI at 104
I reckon mags will give him 18 months with a reduction if he attends a drink course.
Better prepare him to lose his job

if it will affect His Liveliehood he cant get a ban as Magna Carta says, "not so severe as it will affect His Livelehood"

He reckons he will get 30+ months. I'm not sure it will be that long.I'll pass on compliments.....

Does he need to lose his job? Surely he can still mend cars and drive them on private ground (his garage's forecourt)?

Lad at my old company blew 80 something and got 20 months. Pleaded that he drove for a living even had a letter from work stating they would fire him but the courts didn't care (rightly so).

As an auto technician he needs insurance through the dealership or garage in order to be able to test drive customer's cars (forcourt won't cut it) and with a DUI he can't. Unfortunatly in the U.S he would lose his job, not sure about the U.K. but it doesn't look good.

Had a mate refuse to blow and got a 12 month ban. When he was breathalysed the next morning (in the cell) he was still over the limit, though! (prick)

He got caught again (prick) at the beginning of this year and blew 45. 3 year ban as his second offence, despite the fact he needs to drive to run the family business, and there's more than just his own livelihood resting on it (if it'd been his first time, he said they would've let him off with a month at most). Prick.


A reading of 104 would (roughly) equate to 4-5 pints of Stella if my alcomaths is correct...

104, hes looking at atleast 18 month ban £500 fine, if hes lucky! isnt that about 3 times over the limit?

What I am about to say assumes it is his first offence.

At my local court he would be banned for 24 months and made subject to a Community Order with either....

A Rehabilitation Requirement, if the court thinks he has a drink problem.

or...

About 100 hours of unpaid work.

A second offence at that level would possibly see him in prison.

Disqualification obligatory, for a minimum of 3 years if it is the second such offence in 10 years.

I would agree. The limit is 35 so this is 3 times the legal limit. I have seen higher but usually in alcoholics. I would regard a 2 year ban as likely with a community penalty. One "mitigating" factor they will consider is the quality of his driving but irrespective of the fact he may have appeared to be in control, they will still not ignore the danger to other road users that 104 represents.

Exceptional hardship is not to the person but more often to others his wage or driving supports but a Court would be foolish to even consider it with a reading like that.

I should add that most Courts offer a rehab course which will reduce the period of disqualification if you pass the course but sometimes this is a cleft stick as some increase the length of the ban and offer the course as an incentive to do it because, let's face it, some people need educating about the danger of drink driving and the consequences.
