The obstruction must be wilful. The defendant must intend to behave in such a way as to make it more difficult for the constable to carry out their duties.

Question. Supposing i painted my car matt black, had no reflective markings at all on the front, so no foglights, no side markers, and no number plate, wouldnt this be doing the same thing?
Im preventing a reflection of a coppers laser by painting my vehicle "the wrong colour" for a best reflection!
Even tho the paint is passive and id not actively be doing "anything" at the time of the speed check.
So; Plodski cant get a reading and says , " ey up! e's got 'im one 'o them there jammers fitted" and later decides to pay me a visit for interfering with him (lucky guy) while in lawful execution of his duty.

Would that not be exactly the same thing?

Deltaf - my short answer would be that you'd have to try it and see what happens - it's one of those areas that's subject to a lot of interpretation.

Just on my way out of the door to work ( www.pistonheads.co.uk/gassing/topic.asp?t=103822&f=23&h=0 ), but there is a load of various case law on what is and is not obstruction. Let me know if you want those posting.

The purpose of my post with the actual definition wasn't meant one way or another - it was just put up to give the definition, without comment from me.

Thanks, Dibble. We'll never know until someone is prsecuted, pleads not guilty and is acquitted or convicted in the Crown Court.

It may not end at the Crown Court if they have a successful appeal against a conviction - could go all the way to European Courts etc etc.

From a purely personal POV, what would you like to see happen as regards this? Would you be happier if the right to silence was upheld, thereby preventing the talivan scum from getting their cut or maybe not?
