As the people caught taking photo's are being prosecuted does this mean you cannot take photo's of a crash scene and under what law would they be charged?

There's no legislation* that prohibits taking photographs in a public place. In fact there is case law that supports the taking of photos and making sound and video recordings in public. However there's lots of law about doing stupid and dangerous thing WHILE DRIVING.

- Some already defined places and establishments are regarded as sensitive under the Offical Secrets Acts and various bits of anti-terror legislation. There is a place on the A480 just outside Hereford that is so covered; there are signs in the layby to that effect. You may find similar restrictions in Cheltenham, Aldermaston, Faslane.
